People v. King
On June 29, 2010 the Court of Appeals of the State of New York decided the Case of People v. Brian King. Brian is Mr. Mohun's client who was stopped on his motorcycle in the Town of Batavia by the State Police. Mr. Mohun argued from the very beginning while the matter was pending in Town Court that the stop was unconstitutional and violated Mr. King's Fourth Amendment Rights against unreasonable searches and seizure.
Both the Town Court and the County Court ruled in favor of the Police action. Mr. Mohun took the appeal to the highest court in New York State, the Court of Appeals. Oral Argument was heard on June 3, 2010 (link to video). On June 29, 2010 the Court of Appeals overruled the County Court Decision and ruled in favor of Mr. King. The Court of Appeals held that the police action was unconstitutional and suppressed all evidence flowing from the stop of Mr. King's vehicle. The Charges pending of DWI and driving with more than .08 Blood Alochol Content will dismissed at the Town Court Level (link to decision).
